Submissions on Pay Anomaly of Superintendents




Dear friends and Comrades,

In the meeting convened by the CBEC under the chairmanship of Member (Admn), we have projected the pay anomaly pertaining to our cadre.  While we are yet to get back the parity with DySP of CBI, we have been further overtaken by the Superintendents of Posts and Section officers in the CSS.

We have also pointed out how the 7th CPC erred in stating that the V CPC found no ground to have parity between our cadres and that of the CBI.

Para 11.8.21
The Commission has noted that the VI CPC had placed Inspector (Posts) at par with Inspectors of CBDT/CBEC. Subsequently the inspectors of CBDT/CBEC were elevated to GP 4600. The Commission has further noted that Inspector (Posts) and Inspectors of CBDT/CBEC are recruited through the same combined graduate level examination. The Commission, therefore, recommends that Inspector (Posts) who are presently in the GP 4200 should be upgraded to GP 4600. With this upgradation, Inspector (Posts) shall come to lie in an identical grade pay as that of their promotion post of Assistant Superintendent of Posts (ASPOs). A higher grade would thus need to be extended to ASPOs. Accordingly, the Commission recommends that the promotional post of ASPOs be placed in the next higher GP 4800 and further, the post of Superintendent (Posts), which is presently in the GP 4800, be moved up to GP 5400 (PB-2)’

Similar anomaly has been created while allowing replacement pay in Level-9 to the Section Officers of CSS from the 6th CPC pay in GP 4800.
The association had demanded restoration of parity of Central Excise Superintendent with the Deputy Superintendent of CBI i.e. replacement scale of Rs.5400/- Grade Pay in PB-3, based on the analogy accepted while the pay scales were revised with effect from 21.04.2004.  But the Commission instead of restoring that parity, broke one more parity that existed between the Superintendent of Central Excise and the Superintendent of Posts by assigning replacement scale of Grade Pay 5400 in PB-2 to the Postal Superintendents, but granting only the replacement scale of Rs. 4800 in P.B 2 for the Superintendents of Central Excise.  The anomaly militates against the position of the 7th CPC itself in Para 11.8.21. placing Inspectors of Post at par with Inspectors in CBEC/ CBDT. The above position is also without taking into consideration the level of responsibilities of the respective cadres.
In para 11.18.61 the 7th CPC states: “It has been demanded that the post of Superintendents and Appraisers may be upgraded from GP 4800 to GP 5400 (PB-3) on the grounds of historical parity between the gazetted executive officers of CBI, IB, Central Police Organisations, Enforcement Directorate, Customs, Income Tax and Central Excise.”
In para 11.18.62 the CPC says: “As reflected earlier, the V CPC had specifically noted that no relativity could be established between executive posts in Income Tax and Customs vis-à-vis those existing in CBI/IB.”
The above observation is erroneous because the 5th CPC had clearly stated that there was no justification to increase the pay scale of Inspectors/DySPs and recommended that they be brought down to that of that of Inspectors/Supdts of Central Excise. The categories of Officers on both sides were not found on par only with their counterparts of the Central Police Organisations.  But the Government had not brought down the scales of the Officers of CBI and precisely due to that reason the scales of Officers in CBEC and CBDT were revised upwards with effect from 21.04.2004. The 6th CPC had again created the same anomaly.  But instead of settling that anomaly, now the 7th CPC has created a further anomaly by placing comparable officers of Posts and CSS have been placed on Level 9 while Supdts of Central Excise are only on Level 8.
