Interim order of the Hon'ble Supreme Court in Bharathan case




The Order of the Hon'ble Supreme Court in the case of Bharathan and others is given above.

Some members have called me and raised the following questions in this regard:

1) Why the order refers only to the stand of the Department and not of the respondents.

2) Why the Hon'ble Court has not gone into the veracity of the statements referred therein

3) Why there is a sudden reference regarding promotee versus DRs when through out the proceedings, it was only regarding pre 1.3.86 and post 1.3.86

4) Whether it is a fact that no pre 1.3.86 DR is a junior to post 1.3.86 DR

5) Whether without the SLP being admitted, an IA is permissible to be disposed off?

6) For such a decision on an IA, without going into the merits, why 7 hearings were required?

7) Whether for each DPC the CBEC will go on IA?

I do not have any reply for any of the above questions.  I am consulting our Advocate on the matter.
